I am an Individual Investor who meets one of the requirements of a “Qualified Eligible Person” under Rule 4.7 of the Commodity Futures Trading Commission as described below:
Currently I: (i) have an individual net worth, or joint net worth with spouse, of at least $1,000,000; or (ii) have an individual annual income in excess of $200,000 in each of `the last two years, or joint income with spouse in excess of $300,000 in each of the last two years, and have a reasonable expectation of reaching the same income level in the current year; and (a) Own securities (including participations in commodity pools) of issuers not affiliated with me and other investments with an aggregate market value of at least $2 million: or (b) Have had on deposit with a futures commission merchant for my own account at any time during the past six months of at least $200,000 in exchange–specified initial margin and options premiums for commodity interests transactions; or (c) own a portfolio comprised of a combination of the funds or property specified in (a) and (b) immediately above in which the sum of the funds or property under (a) expressed as a percentage of the minimum amount required thereunder and the amount of futures margin and options premiums includable under (b) expressed as a percentage of the minimum amount required hereunder, equal at least 100%. [An example of a composite portfolio acceptable under (c) could consist of $1 million in securities and other property (50% of (a)) plus $100,000 in exchange-specified initial margin and options premiums (50% of (b)).]
